Determining Disability Eligibility

The process of figuring out what you are eligible for and then actually getting those benefits can be confusing. Deissner Law Office can help you understand the two key sets of criteria: your financial and your medical circumstances.

Financial criteria

Before you can qualify for Social Security Disability Income (SSDI), you must have already paid into the system by working for at least 5 out of the last 10 years. If you don't meet this requirement than you may qualify for Supplemental Security Income (SSI) instead.

Medical criteria

In order to qualify for SSDI or for SSI you must have a medically provable impairment, physical or mental, that precludes you from working in any kind of gainful employment - not just in your own field.

This assessment includes how your disability would affect your ability to hold a job in the long term. For example, if you could reasonably expect to miss more than one day of work a month due to incapacity, that would be taken into account.

Denial doesn't mean ineligible

Most applications for SSDI are actually denied on the first time through the system - and then approved after one reapplies with a stronger case. If you've been turned down, contact us.
